1. TYPE OF PERSONAL DATA PROCESSED
KitchenAid processes the following categories of personal data, depending on the type of interaction with you:

KitchenAid processes personal data concerning you collected or provided directly by you through different channels and on different occasions, as well as from different sources. Examples of personal data we collect include:
- personal data provided at the time of creating an account on the Website and/or on the App, of purchasing a KitchenAid product or service through the Website, of registering the product purchased, sending a request for information, assistance or services related to the purchase (such as, name, surname, residential address, e-mail, birthdate, telephone number, appliances purchased by you, services requested by you);
- personal data provided during phone calls to our call centers (including call dates and times, caller contact information and information relating to your order);
- personal data you have provided to us or third parties when registering for marketing communications (in electronic or non-electronic form, e.g. newsletters) or promotions, prize draws or competitions;
- personal data contained in images, audio and/or video you submit or allow the App to capture;
- personal data provided by other parties’ products or services that you connect through the App.
In addition, KitchenAid collects data about the appliances you purchase and/or the services you order, including requests for warranty services.
We may receive your personal data from third parties, such as insurance and distribution companies.
2. Data collected through the Website and Apps
The Website and Apps collect your personal data for various reasons (including technical and related to their functioning), such as: (i) the IP address and domain name of your computer; (ii) the type of browser and operating system used; (v) the physical location of your device (as determined, for example, using satellites, mobile phone towers and WiFi signals); and (iii) other information about your online session, such as the Uniform Resource Identifier (URI) addresses of the requested resources, the time of the request, the method used to send the request to the server, the size of the file received in response, the numerical code related to the status of the response received from the server and other parameters relating to the operating system used by the User's device. We may track and collect App usage data, such as the date and time the App accesses our servers or what information has been downloaded to the App.
The data collected through the Website and the App are also used for the purpose of collecting anonymous statistical information on the use of the Website, the App and to check their correct functioning, and are stored according to our information retention requirements. However, for some activities, such as after-sales services or control and/or performance measurement activities, personal data may be processed.
This data may also be used to ascertain liability in the event of computer crimes perpetrated against the Website and/or the App.
On our Website, we may collect both information that does not constitute personal data (for example, to check the Website is properly functioning and to produce anonymous statistics on the use of the same), and information that contains personal data of the User, through different types of cookies or other tracking technologies (for example, pixels and web beacons), after you have given your consent to the installation of such technologies (where consent is required). Your personal data is processed with the support of Information Technology and/or paper means and it is protected by appropriate security measures suitable to ensure the secrecy and security of the personal data. More specifically, KitchenAid adopts the appropriate administrative, technical, personal and physical measures designed to protect personal data against any loss, theft as well as unauthorized use, disclosure or modifications of the personal data.
Additionally, where we process your personal data with the support of Artificial Intelligence (AI) (like in case of customer service support tools), KitchenAid ensures that all necessary privacy and security measures are implemented (for example, we only use the necessary data and anonymize your personal information before it is analyzed by the AI system, and we ensure all appropriate security measures are in place). We also ensure that there is a human oversight over all such processes, to ensure that the service you receive is not biased or does not make automated decisions without review.
4. COMMUNICATION OF DATA
Your personal data will be processed by KitchenAid employees, who have been trained and authorized to process personal data in accordance with the provisions of the GDPR.
Your personal data may also be shared with the following recipients (please note that not all of the listed third parties will receive your data):
- companies of the Whirlpool Group located in the United Kingdom (UK), European Economic Area (EEA) and outside the UK or EEA, acting as autonomous controllers;
- service providers located in the UK or EEA and outside the UK or EEA, such as, IT service providers (e.g. e-mail and cloud providers) and systems management and IT maintenance professionals, distributors of our products, suppliers of logistics and delivery services for our products, suppliers of technical assistance services, repair and maintenance of our products, call center operators and customer service providers, agencies and providers of services of digital marketing and advertising of our products (for example, Meta Platforms Ireland Limited), reviews and ratings service providers, cookie providers, tracking technologies and web / email analytics services (for example, Google Analytics offered by Google LLC.). These entities work on our behalf as data processors or independent data controllers, as appropriate;
- electronic payment service providers, in order to manage payments related to your orders. For the sake of clarity, KitchenAid does not process any banking / financial data (including credit card information) of the Users. In relation to this processing, the electronic payment service providers will process your personal data as independent data controllers, in compliance with the GDPR (and with any other applicable local legislation) and with the relevant privacy policies. KitchenAid is not responsible for any damages (including those deriving from the violation of the GDPR and any other applicable data protection legislation) deriving from the processing of the User's banking / financial data (including credit card data) by such third parties;
- Nayan NV, operator of the KitchenAid online shop and the seller of the items sold on this Website, whose office is located at Pittemsestraat 58D, 8850 Ardooie, Belgium. Nayan is a recipient of your data for the purposes of the contract concluded with you when purchasing an item from this website or extended warranty services;
- independent authorities, law enforcement agencies and/or judicial and administrative authorities for their institutional purposes as prescribed by law;
- third parties involved in an extraordinary corporate transactions, such as a merger or the sale of a business unit, including those who provide them with advice in the context of the transaction;
- entities that provide specific legal, financial or tax consultancy services;
- For the purpose of analysis, the emails of our newsletters contain a "tracking pixel", of the company Salesforce.com Inc. which connects to the servers of Salesforce when the email is opened. In this way, it can be determined whether a newsletter email has been opened.
Remarketing, Social Media and Affiliate Marketing recipients of data: - Meta Platforms Ireland Limited ("Meta Ireland"), which provides KitchenAid with a service for the creation of targeted audiences as well as with a tracking technology (pixel) through which personalized advertisements or web forms through which users can subscribe to commercial communications from KitchenAid are displayed on the social network. Through the service known as Custom Audience, KitchenAid sends Meta Ireland your contact details in order to create an audience of consumers to be targeted on the social platform with marketing communications: for such processing activities, KitchenAid is the data controller while Meta Ireland is our data processor and a data processing agreement has been concluded. The pixel (called Facebook pixel) tracks your behaviors and interests shown on the Website, transmits them to Meta Ireland and, also by combining the information it already has about you, shows you interest-based advertising of KitchenAid products (known as Website Custom Audience), or web forms to subscribe to commercial communications from KitchenAid (known as Lead Ads), to you or to users of Meta Ireland who have common or similar characteristics / interests to yours (known as Lookalike Audience). For the processing carried out jointly in order to show you the advertisements or web forms indicated above, we and Meta Ireland act as joint controllers and, to this end, we have entered into a joint controller agreement which sets out our responsibilities to comply with the obligations under the GDPR (available at the following link). (or its subsidiaries), which provides KitchenAid, as part of the Google Ads services, tracking technologies through which personalized advertisements or web forms in which to subscribe to commercial communications from KitchenAid are displayed by Google LLC. within its services. These tracking technologies (remarketing pixel and Google Analytics integrated with Google Ads) track your behavior and interests on the Website, transmitting the relevant information to Google LLC. - Our website uses a pixel (Pinterest tag) of Pinterest Europe Ltd. (Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland ("Pinterest"). Via the pixel, information about your surfing behaviour can be collected, stored and analysed in pseudonymised form. The information can be assigned to your person with the help of further information that Pinterest has stored about the user, e.g. due to the ownership of an account on the social network "Pinterest". Pinterest uses an algorithm to analyse surfing behaviour and can then display targeted product recommendations as personalised advertising banners on the user's Pinterest account. Pinterest may also combine the information collected via the pixel with other information that Pinterest has collected via other websites and/or in connection with the use of the social network Pinterest, and thus create pseudonymised usage profiles. For remarketing services, our website uses the conversion tracking technology "Pinterest Tag" from Pinterest. If you have reached our website from a pin on Pinterest, we set a cookie on your computer, which interacts with a likewise implemented "tag" in the form of a JavaScript code from Pinterest. - Awin AG, which provides KitchenAid with tracking technology as part of affiliate marketing activities. Affiliate publishers place advertisements from KitchenAid on their websites and, when you click on the advertisement, you are redirected to the website which, using the tracking technology provided by Awin AG, recognizes whether the originating website belongs to an affiliate publisher and tracks whether you make a purchase. For processing carried out jointly, KitchenAid and Awin AG act as joint data controllers and for this relationship we have entered into a joint-controller agreement that sets out our respective responsibilities with regard to compliance with our obligations under the GDPR (the essential content of which can be requested by sending an email to global_privacy@whirlpool.com). You may address your inquiries or exercise your rights with regard to the data processing carried out jointly with both joint controllers. 5. DATA TRANSFER OUTSIDE OF THE UK AND EEA
We may transfer your personal data to a country outside the UK or EEA. Any transfer of your personal data to a country outside the UK or EEA (whether within or outside the Whirlpool Group) will be done in accordance with the GDPR when:
- the country to which the personal data is transferred has been the subject of an adequacy decision by the European Commission (or England Department of Media Culture and Sport, where applicable), pursuant to Article 45 GDPR; or
- when adequate safeguards have been provided by or to the Whirlpool Group company exporting your personal data, pursuant to Articles 46 - 48 GDPR, including, without limitation, when the importer has signed the standard contractual clauses made available by the European Commission or, where the UK GDPR applies, the international data transfer agreement or international data transfer addendum made available by the UK Information Commissioner's Office. In any case, the transfer based on one of the instruments indicated in Articles 46 - 48 GDPR will be accompanied by additional contractual, organizational and technical measures, if this is necessary to ensure that your personal data is guaranteed a level of protection substantially equivalent to that guaranteed in the UK or European Union.
